Illinois Has Strict Penalties For DUI

Lawmakers in Illinois have ensured that police and prosecutors have many options at their disposal when dealing with drivers who may be intoxicated. As an implied consent state, you are legally consenting to a blood alcohol concentration (BAC) test every time you drive. Therefore, your license can be immediately suspended if you refuse to submit to a sobriety test if pulled over. The legal process moves quickly after an arrest. Prosecutors will work hard to secure a conviction, and the punishments you may be facing include:

	For a first offense - Up to 364 days in jail and a fine of up to $2,500. Your license may be suspended for up to one year.
	For a second offense - License suspension plus minimum of five days in jail if your second offense is within five years of your first.
	Third or fourth offense - As a Class 2 felony, you can face between three and seven years in prison. You may have fines up to $25,000.
